Terms of Service for LearnUps
Effective Date: January 23, 2026
We are excited that you are interested in LearnUps services. Our goal is to provide you with an exceptional and transformative educational experience. By accessing or using our online homework system, you agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, please do not use our services. Throughout this document you will see (LearnUps) to refer to LearnUps , LLC. We also have employees, independent contractors, and other representatives that we refer to as (contractors). As a user of the Service or a representative of an entity that uses the Service, we refer to (user) in this agreement. The Term begins when you begin to use LearnUps Services and continues as long as you use the Services. Using LearnUps system means that you agree to the Terms.
1. Acceptance of Terms
Our services are designed for students and educators who are at least 13 years old. Some of our content links to 3rd party sites. Most of those links are great but we cannot control and are not responsible for what happens on those sites. If you access any third party website, service, or content from LearnUps, you do so at your own risk and you agree that LearnUps will have no liability arising from your use of or access to any third-party website, service, or content. If you find something that is not appropriate, we want to know about it. Please tell us, and we promise to listen and take whatever action we think is appropriate, including removing the link or replacing it with an alternative.
2. Services Provided
LearnUps offers an online platform for students and educators that amplify their work and strengthen the connection between them. This includes but not limited to complete assignments, quizzes, and access educational resources. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services. Our Services use openly licensed educational resources such as text, images, videos, interactive activities and other media (OER). Nothing in these Terms limits your rights granted under specific OER licenses. We reserve the right to modify or discontinue our services at any time without notice
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary.
- We care about your security. We maintain appropriate procedural, physical, and technical safeguards to protect the security, integrity, and durability of your account and your content. Despite our best efforts, we cannot guarantee that our methods will be effective in all circumstances. You are responsible for keeping your user account and password secure. Please notify us right away of any unauthorized use of your account.
4. User Conduct
Our courseware is a place for people to learn and enhance their lives through education. If people do not feel safe, they have difficulty learning and contributing to the learning experience.
These guidelines clarify what we do and do not allow on LearnUps.
You agree to use the services only for lawful purposes and in accordance with these Terms. You must not:
- Use the service in any way that violates any applicable laws or regulations.
-Impersonate any person or entity or misrepresent your affiliation with any person or entity.
-Transmit any material that is unlawful, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- May harm minors.
- Infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service.
- Upload or send material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
- Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
-Intentionally or unintentionally violate any applicable local, state, national or international law.
- talk or otherwise harass another person.
-Collect or store personal data about other users in connection with the prohibited conduct and activities set forth in this policy.
-Share/send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation.
-Perform behavior that disrupts the normal flow of dialogue, or otherwise negatively affects other users ability to engage in discussions or exchanges.
5. Intellectual Property
All content, features, and functionality of the service, including but not limited to text, graphics, logos, and software, are the property of LearnUps or its licensors and are protected by copyright, trademark, and other intellectual property laws.
If you believe that your content is being used on our website or in our products in a way that violates your rights, we want to know about it. Please let us know by sending a message to contactus@learnups.academy. We will respond quickly to any report of a violation and will act in accordance with the Digital Millennium Copyright Act. This copyright policy applies to our website as well as any other sites owned and operated by us. It also applies to all uses of the platforms and services we provide.
6. User-Generated Content
You may have the ability to post, submit, or otherwise share content through our service. You retain ownership of any intellectual property rights you hold in that content. By submitting content, you grant LearnUps a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with our services.
7. Free Trials, Fees, and Refunds
Some of our courseware is available in a free trial (14-days). Your use of our Services during a free trial is subject to these Terms and may be terminated at the conclusion of the trial unless your use becomes eligible in accordance with these Terms, including the Fees described here.
Some of our Services, like the OER content on our website, are available for free. Our courseware, which also contains OER content, is not free. Your eligibility to use our courseware is subject to payment for your use by you or your institution.
You are eligible to use our Services, including Support, if you are an instructor for a course that has been paid for by your institution, or directly by the students in the course.
You are eligible to use our Services, if you are a student and the required fees have been paid. Fees for each course are valid only for one semester of the school year either fall, spring, summer, and winter. Fees may be paid in a number of ways, including:
-Purchase of an activation code, often through the campus bookstore.
- Credit card, debit card, and PayPal.
We provide refunds if:
A· We stop providing our Services to you for a reason that is not laid out in these Terms or our Acceptable Use Policy
We are not obligated to provide a refund for any other reason. Please request refunds to contactus@learnups.academy
If you have purchased an activation code from your campus bookstore, or any organization other than us, you must request a refund from that organization. Please note activation codes are valid for the current term only.
8. Termination
You or LearnUps may terminate this agreement at any time and for any reason. We may suspend our Service to you at any time, with or without cause. If we suspend or terminate your account without cause, we will refund any fees you paid us for the period. We will not refund or reimburse you if there is cause, like a violation of these Terms or our Acceptable Use Policy. Once terminated, we may permanently delete your account and all the data associated with it. If you do not log in to your account for three months or more, we may treat your account as inactive and permanently delete the account and all the data associated with it.
Even if this Agreement is terminated, the following sections will continue to apply: Your Content, Copyright, Limitation of Liability, No Warranties, Indemnity, and Severability.
9. Disclaimers and Limitation of Liability
Our services are provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, secure, or free of errors. We disclaim all warranties to the fullest extent permitted by law.
You agree to indemnify and hold us and our Team harmless from any losses, including attorney fees that result from any claims you make that are not allowed under these Terms due to a Limitation of Liability or other provision. You also agree to indemnify and hold us harmless from any losses that result from third-party claims that you or someone using your password did something that, if true, would violate any of these Terms.
You may not assign your rights in this agreement to anyone else. We may assign our rights at our discretion.
If we learn that a part of this Agreement is not enforceable, we will remove or modify that part, and the rest of the Terms will still be valid.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the service after changes indicates your acceptance of the revised Terms.
